The Swedish Patent and Registration Office (PRV) proposal is for a renewed capacity development program in Intellectual Property (IP) with a focus on Least Developed Countries (LDC). This new program is based on the three previous International Training Programmes (ITP) PRV conducted for more than 10 years and on the results from the 2014 external evaluation of these programs. Additionally, the program will also cover use of IP in the area of Genetic Resources. There are two main arguments for supporting a capacity development program in Intellectual Property in Least Developed Countries (LDC). First, many LDCs lack knowledge of how Intellectual Property (IP) can be used to protect and stimulate the creative arts, innovation, industry and trade and of how IP systems can be developed and used for a country's economic development. Studies have shown that the use of copyright protection alone can contribute to a country's GDP by as much as 5 to 7% (in some developed countries this is much higher, for example 11% for the USA). Add to this the more advanced IP systems in patenting and industrial property and that contribution to GDP jumps to 30 - 40%. The second argument involves the compliance of these countries to the World Trade Organisation (WTO). Being a member of the WTO brings significant benefits in respect to international trade and while most countries already have a form of membership, to become a full member, they must conform to "TRIPS", the Agreement on Trade Related Apsects of Intellectual Property Rights. TRIPS forms part of the WTO system of agreements governing international trade and must be adhered to if a country is to maintain membership in WTO. Least Developed Countries have been given an extended grace period, until 2021, to be able to fulfil the TRIPS requirements. The World Intellectual Property Organisation (WIPO) is working together with the Swedish Patent and Registration Office (PRV) to implement sufficient training for LDCs to be able to develop their IP systems, conform to TRIPS and thereby qualify for continued WTO membership. The planned outcome is that there will be a sufficient human capacity to accomplish the objective of each country developing an IP system, thereby adhering to TRIPS. The Swedish Patent and Registrating Office (PRV) has been running three International Training Programs (ITP) in IP for over 10 years; these programs have addressed the capacity needs of both low and middle countries including LDCs. It is now proposed to prioritise those LDCs identified with the most urgent needs and with the highest potential for economic growth from the introduction of an IP system. The aim of this is to concentrate on obtaining a critical mass of trained people in these LDCs. The participants would come from public institutions, private sector, civil society and academia and would have a mandate to develop the country's IP system. PRV is assisted in the recruitment of key participants by WIPO, the UN organisation responsible for international coordinating efforts in the area of IP. A further development of this proposed program is greater cooperation between PRV and other partners, both in Sweden, EU, and in proposed countries. One example of this is that PRV has been approached by the East African Community (EAC) to assist in establishing regional training programs in Intellectual Property in Arusha, Tanzania. The International Training Programs have proven to be very effective, but they are relatively costly and limited due to available participants who can be accommodated and who are not always able to leave their work for the entire length of a training progrm or at the particular time programs are being offered. Parallel to the traditional ITP programs which are planned to be implemented as previously, it is proposed that some training activities take place locally. The BAE (Bilateral Associate Expert) program was initiated by Sida in 1985, as a complement to the multilateral/UN program, JPO (Junior Professional Officer). The objective of the BAE program is to provide technical assistance to and strengthen capacity of the receiving organization through a young expert. A BAE is a young professional below the age of 33, who holds a university degree and has at least two years of relevant, paid, work experience. In the recruitment process, Sida and the receiving organization look for young professionals with knowledge and skills relevant for the organization, as well as the potential and willingness to learn and grow during the assignment. BAE:s are mainly placed within a cooperating partner organization in the global south, be it local/international NGO:s, public agencies, ministries, etc. working with international development, such as International Planned Parenthood Foundation, Saferworld, Slum Dwellers International, Western Indian Ocean Marine Science Association, Agence de l'Environnement et du Développement Durable in Mali, etc. The receiving organization drafts the ToR and is highly involved in the recruitment process, in order to ensure local ownership. Before deployment, all BAE:s undergo a one week onboarding in Sweden, to prepare for their missions. The BAE contract is for maximum three years and before starting the third year, a BAE may relocate to an Embassy working with international development.

PRV has been running three International Training Programs (ITP) for over the past ten years with over 700 participants. In order to assess the results and determine how well the program meets Sida's priorities and responds to the needs of the countries in the area of ??IP rights (Intellectual Property), a results seminar will be held in autumn 2014 and an evaluation consultant engaged to take up the results, experiences (lessons learned) and to provide recommendations for future programs. The evaluation consultant and PRV will cooperate on developing a survey to be sent to all former students. Selection of participants for results seminar will be will be made by the evaluation consultant and a project manager from PRV and based on the survey response, the number of countries represented. PRV shall assist the evaluation consultant with program documentation and assist with the administration of data collection such as interviews with participants. Some of the participants' organization / authority / company and responsible persons at the UN agency WIPO will also be interviewed. The objective of evaluation and performance workshop is to highlight results from the ITPs and provide an analysis of the area Intellectual Property (IP) for future Sida and PRV planning and decisions of new programs. It is proposed that allotted 3,600,000 Swedish crowns be allocated for the results seminar, while the proposed budget for the evaluation consultant is a maximum budget of 750,000 Swedish crowns. The time frame for the evaluation is in 2014 with an inception period in the spring which includes cooperation on the development of the survey and in the fall in the participation in the results seminar. A final report must be submitted not later than 3 months after the results seminar end.
