Bringing together the main UN entities (UNDP\u002FUNWomen\u002FUnicef) mandated and invested in these areas in an integrated programme framework (three years, with provision for a further two optional years), the Sawasya II will contribute towards a functioning and inclusive rule of law system that respects, protects and fulfils human rights and gender equality and promote peace and security. Sweden aim to contribute with financing for the programme starting 1 April 2019, but has been involved in the development of the programme and monitored it closely since the start in July 2018, hence supports the efforts that have been made and results that have been achieved since then. \n\nAccess to justice is a basic principle of the rule of law. In the absence of access to justice, people are unable to have their voice heard, to exercise their rights, to challenge discrimination or hold decision-makers accountable. Acknowledging that the ability to access justice is a human right initself and is key to the realization of all other human rights, Sawasya II will address gender justice gaps and structural discrimination against women which are deeply entrenched in the justice and security systems in Palestine. To do so, Sawasya II has conducted a gender analysis of the underlying causes of gender inequality and discrimination against women, and investigated the impact of those causes on women’s access to justice and their realization to human rights. Sawasya II adopts a holistic gender mainstreaming approach and developed a gender strategy which sets out tools, methods and approaches to ensure that women’s rights, needs and interests are adequately reflected in the programme’s policy, programming frameworks and directions.\n\nThe Sawasya II programme builds on the accumulated experience and expertise of the involved UN entities, at both global and local levels, including that of the Sawasya I joint programme of UNDP and UNWomen, as well as the experience of Unicef.  The process for developing the programme proposal for Sawasya II has been thoroughly based upon previous experiences, evaluations and an intense dialouge with all partners and stakeholders connected to the programme. From the perspective of the UN implementing agencies, the focus, content and strategy of Sawasya II has been informed extensively by discussions with Palestinian counterparts and stakeholders. The programme has identified key lessons learnt from the implementation of the Sawasya I programme in terms of: i) strategic and thematic focus; ii) programme implementation strategy; iii) programme governance structure; iv) programme management arrangements and v) programme gender, children and women’s human rights integration. These lessons learned, which drew on the recommendations of a mid-term strategic review, the final independent evaluation of the Sawasya I programme , an independently produced report by Clingendael Institute , and rolling internal analysis, have informed the design of Sawasya II. The implementing UN agencies have also drawn upon analysis and commentary on relevant issues emanating from multilateral forums concerned with Palestine, such as the Ad Hoc Liaison Committee and on the experiences of other political, development and humanitarian actors on the ground.\n\nThe Programme aims to leverage partnerships with other key bilateral and multilateral development partners, including the Office of the United Nations Special Coordinator for the Middle East Peace Process (UNSCO), the Office of the Middle East Quartet, the European Union (via both the Office of the EU Representative and the EUPOL COPPS mission), and lead bilateral donors in the justice and security sectors.",{"lang":212,"value":220},"Rättssektorprogrammet, Sawasya II, syftar till att främja rättsstatsprincipen, integritet, jämställdhet och mänskliga rättigheter i Palestina för perioden 2019-2021. För att kunna göra detta har Sawasya II genomfört en jämställdhetsanalys av de bakomliggande orsakerna till bristen på jämställdhet mellan könen och diskriminering av kvinnor och undersökt effekten av dessa på kvinnors tillgång till rättslig prövning och deras förverkligande av mänskliga rättigheter. Each indicator had an annual target and a cumulative target. 34 out of 41 targets were achieved (82.9%). 2 indicators (accounting for 4,9%) were cancelled during implementation due to the cancelation of the associated activities, one of these was related to the reconciliation process with Gaza, which during the program implementation period was not possible to achieve. The other cancelled indicator related to the community police and was due to lack of internal agreement within the police on the community policing concept. As regards the remaining 5 indicators that were not achieved, three faced issues with data collection to verify targets and only 2 were actually not reached. The report also contains qualitative description of achievements and a reflection on the main challenges; lack of political will for certain policy reforms (including legal aid and the family protection bill), COVID 19 and the Gaza war, and makes a brief analysis of the way forward post Sawasya II. \n\nThere is no doubt that the Sawasya program has achieved impressive results in many areas. This includes the area of results based planning and M&E at the justice institutions themselves (Output 1.2), which has included development of sector results action plans, creation and capacity building of M&E units and automated reporting, all of which are critical steps towards better governance. In 2021 the PCBS Rule of Law and Access to Justice survey showed considerable improvement in public trust toward the judiciary compared to 2018. \n\nAnother contribution towards accountability is the court monitoring effort through civil society organizations that has been supported through Sawasya. In 2019 a network of CSO were able to monitor 72% of criminal cases in the west bank and 28% in the Gaza strip. The results provided valuable empirical evidence to drive advocacy for judicial reform and compliance with international standards. This activity is a good example of Sawasya's ability to promote civil society organizations role in justice sector reform and service delivery.\n\nMizan II is one of Sawasya's flag-ship products and is now even in demand from other countries in the region through South-South cooperation. A number of digital solutions that have improved enforcement rates, reduced backlog and increased accountability and transparency are provided through this court management system, which has much potential to further enhance digital justice solutions in the third phase of Sawasya. \n\nTwo other Sawasya pilots that have developed into replicable models are the One Stop Centers and the VAW court model which both have increased access to services and improved safety and dignity to victims. \n\nFinally Sawasya's support to child friendly procedures should not be forgotten. The consistent focus on alternatives to detention has lead to a steady decline in non custodial sentences for children and improvement in A2D services. \n\nThe report is long and rich in detail and data (monitoring of data is one of the strong sides of the program), but its reading is facilitated by informative summaries of results. In total it presents impressive results from the program, which has also been corroborated by the external evaluation carried out during 2023.
