It is one of the worst victims of climate change while having hardly contributed to the creation of the phenomenon. As per the Global Climate Risk Index (2021), Bangladesh, a nano emitter, is the seventh most extreme disaster-prone country in the world. At the national level, every single ecosystem and all natural resources are facing severe  degradation as the country's development agenda has been anthropocentric, unregulated, top-down, with limited public consultation and little concern for ecological consequences. Pollution and contamination of all elements of environment, i.e., air, water, soil, is high. \n\nBangladesh Environmental Lawyers Association (BELA), a non-profit association of lawyers, plays a pioneering role in popularizing the concept of environmental justice in Bangladesh, and is the leading local civil society organization working to strengthen the environmental protection legal framework of Bangladesh. Its vision is “community empowerment and protection of the environment, natural resources and environmental rights in a just, equitable and gender sensitive way”. Its mission is “Developing awareness of environmental rights and entitlements as well as capacity to make changes in environmental governance through awareness campaigns, training of various  stakeholders, initiating and pursuing policy advocacy through multiple modes, and litigation to ensure environmental justice”.\n\nThe proposed cooperation will be a new phase of the same program, \"Defending Environmental Rights and Promoting Justice\", and will build on the success, results and lessons from the previous phase. It will be a new 4-year agreement from 1 January 2024 to 31 December 2027. The total contribution is 28 000 000 SEK, out of which 700 000 SEK will be earmarked by the Embassy to conduct an Organisational Review of BELA during 2024. BELA has received approval from the regulatory agency, the NGO Affairs Bureau (NGOAB), for this new program cooperation. \n\nThe overall objective of the new cooperation is \"To protect natural resources, defend peoples’ environmental rights, promote compliance and sustainable production practices, and institutionalize environmental justice\". \n\nBELA intends to utilise legal assistance, advocacy and campaigns, networking and community outreach, and research, publications and awareness building to achieve the expected outcomes of:\n\n- Defending citizen’s rights to the environment;\n\n- Engaging citizens in environmental justice initiative;\n\n- Promoting compliance and advocating for sustainable production practices in the industrial sectors (textiles, tannery, pharmacy);\n\n- Increasing awareness and strengthening networks on environmental justice issues;\n\n- Increasing organizational ability, strengthening networks and contributing to progressive,equitable, effective global legal orders.\n\nThis programmatic cooperation intends to strengthen BELA's capacity to deliver on its core work. What is new in this phase is the focus on promoting compliance and advocating sustainable production practices among industries in three key areas of production: textiles, tannery and pharmaceuticals. These are the three top export industries of the country, as well as the source of major environmental pollution. By working on these industries to promote environmental compliance and sustainable production practices, BELA will also be helping these industries become competitive as they transition into the more stringent international regulatory regime that comes with Bangladesh's graduation from a least developed country (LDC) to a lower middle income country in 2026. Its efforts pressured public authorities and regulators towards stricter enforcement of protection laws and policy implementation. BELA promoted accountability and enhanced environmental governance by holding responsible parties answerable for their actions, such as local public development authorities who disregard environmental impact assessments (EIAs) and safeguards, and corporations who are polluters. Furthermore, BELAs initiatives led to increased compliance and operational efficiency among identified private sector actors, reinforcing sustainable business practices and responsible environmental management.\n\nDuring the reporting period, BELA secured significant judgments on 3 PIELs which have previously been filed. The cases include safeguarding wetlands, agricultural lands, and holding developers accountable for unauthorized environmental damage.\n\nDuring the reporting period, BELA successfully organized 20 community consultations in different districts, addressing a range of critical environmental and legal concerns. These sessions not only facilitated follow-ups on existing cases but also empowered community members to initiate new legal actions on issues related to Water Scarcity & Flooding, River & Wetland Encroachment & Pollution, Brick Kiln impacts on Agricultural Land, Illegal Hill Cutting & Landslides, Industrial Pollution, Unregulated Stone & Sand Extraction and Crushing, Deforestation & Indigenous Rights, and Human-wildlife conflict. Furthermore, a total of 21 Focus Group Discussions (FGDs) were conducted across 6 divisions - Barishal, Chattogram, Khulna, Rajshahi, Sylhet, and Mymensingh - to identify emerging environmental justice issues and assess community perspectives as part of informing about the state of environmental protection capacities in the country.\n\nAnother important legal instrument for environmental protection is the Right to Information (RTI) Act, with BELA serving a total of 113 RTI applications on 77 issues concerning environmental and land-related issues across various districts of Bangladesh. The applications sought information on topics such as pollution, encroachment, wetland and river protection, waste management, and forestry to be used for inspection reports, enforcement records, and legal actions taken against encroachers and polluters. RTI applications were also used to gather information on relevant government initiatives and lease agreements for rivers and quarries.\n\nOutcome 2: Promoted compliance and advocated for environmental justice issues and greener production practices in the industrial sectors\n\nThis outcome is intended to challenge BELA to find ways to engage constructively with private sector actors who are crucial to reducing industrial pollution risks. During 2024, BELA focused specifically on the renewable energy (RE) space, co-organizing the 2nd Bangladesh Energy Prosperity 2050 Conference. This has resulted in constructive engagements with local and multinational energy suppliers and private financiers on joint policy advocacy for championing the transition to 100% renewable energy in Bangladesh. A number of concrete actions are expected to be implemented in the coming years as a result of these efforts.\n\nOutcome 3: Engaged systematically with global movements and local citizens groups in environmental justice initiatives\n\nBELA served as a technical expert supporting Bangladesh official negotiators in the Global Plastics Treaty, participating in the 5th session of the Intergovernmental Negotiating Committee (INC-5) in Busan, South Korea, alongside allies from Friends of the Earth International (FoEI) and the Global Alliance for Incinerator Alternatives (GAIA). It actively raised awareness and engagement among youth groups spearheading national campaigns and public demonstrations against plastic pollution.\n\nBELA was invited by the Bangladesh's government delegation to be one of its technical advisors in the UN Biodiversity Convention (COP 16) negotiations in Cali, Colombia, where Bangladesh reported on progress in compliance to 23 targets for the Global Biodiversity Framework.\n\nFor the UN Conference of Parties (COP29) in Baku, Azerbaijan, BELA was invited to be part of the official country delegation, supporting the negotiations on the New Collective Quantified Goal on Climate Finance (NCQG), and coordinating with Least Developed Countries (LDC) groups and civil society partners of the Demand Climate Justice (DCJ) movement.\n\nOutcome 4: Documented important facts and trends, informed opinions and disseminated knowledge on environmental justice issues\n\nBELA primarily reported activities under this outcome.
