Result
The central issue is the disregard for human rights, which is a primary factor in the developmental challenges faced by Africa. Regionally, this is partly due to the inadequate enforcement of human rights rulings. The low level of implementation of decisions is in turn caused by a number of factors, key among them being the lack of sufficient monitoring and follow-up actions of human rights decisions from regional bodies in Africa. This lack regarding monitoring and follow up actions itself arises from several factors such as the lack of sufficient financial, human and technical capacity within regional bodies and structural challenges for monitoring and follow-up within the African human rights system. Another cause is the low level of cooperation and coordination amongst regional and sub- regional human rights bodies as well as insufficient capacity and coordination amongst and between regional actors (networks of CSOs, lawyers associations, NHRIs and academia) pushing for the implementation of human rights decisions of regional bodies in Africa; and the inadequate collaboration between regional bodies, regional actors and relevant national state actors with the responsibility for implementation of decisions at a national level. The lack of proper follow-up contributes to states non-compliance with human rights decisions of regional bodies and undermined trust and faith in the relevance and effectiveness of regional bodies, and, ultimately, challenges in communities particularly marginalised and vulnerable groups accessing justice and enjoying their human rights, which effectively hinders development. In line with this and building on efforts the previous regional programmes and other similar efforts in the continent, these are accordingly the key challenges and underlying causes that the proposed Programme will seek to address. This programme will therefore overall aim, and focus on efforts, to increase implementation of decisions, judgments, provisional measures, and recommendations from regional and sub-regional bodies in Africa.
